1) Who this applies to

This Participation Disclaimer & Waiver (“Disclaimer”) applies to any person participating in a motorcycle coaching session, training activity, guided ride, tour, clinic, or event (the “Event”) that is provided, organised, or facilitated by Neil Price Pty Ltd and its officers, employees, contractors, agents, volunteers, and (where relevant) third-party suppliers (together “Neil Price Pty Ltd”).

This Disclaimer is between the participant (“I”, “me”) and Neil Price Pty Ltd. Participation is conditional on accepting this Disclaimer before taking part.

If I am under 18 years of age, a parent or legal guardian must accept this Disclaimer on my behalf and be responsible for my participation.

2) Important legal note

Nothing in this Disclaimer excludes, restricts, or modifies any right or remedy that cannot legally be excluded under applicable law (including the Australian Consumer Law).

3) Acknowledgement of risk

I understand that motorcycle riding and training (especially off-road riding) involves inherent risks that cannot be eliminated without fundamentally changing the nature of the Event.

These risks include, but are not limited to:

• collision, falls, and impacts (with terrain, objects, vehicles, or other riders)
• rider error, loss of control, or poor judgment
• mechanical failure or equipment malfunction
• changing terrain conditions (sand, mud, rocks, ruts, steep descents, water crossings)
• weather exposure, heat, dehydration, fatigue, stress, and overexertion
• encounters with animals or other hazards
• acts or omissions of other participants or third parties

I acknowledge these risks may result in serious injury, permanent disability, death, or property damage to myself or others.

4) Voluntary participation and responsibility

I voluntarily choose to participate and accept that I am responsible for my own decisions and actions during the Event.

I agree to:

• ride within my own skill, fitness, and experience
• comply with instructions and safety guidance given by Neil Price Pty Ltd
• comply with all applicable laws and local rules
• wear appropriate protective gear suitable for the Event (e.g., helmet, boots, gloves, eye protection; and other gear as instructed)
• behave in a safe and respectful manner toward others

5) Fitness, medical conditions, and disclosure

I confirm that I am physically and mentally fit to participate. I will disclose to Neil Price Pty Ltd any medical condition, injury, medication, allergy, or other factor that may affect my ability to participate safely.

I understand that riding while injured, unwell, overly fatigued, or impaired increases risk.

6) Equipment and motorcycle condition

I am responsible for ensuring any motorcycle and equipment I use (whether supplied by me or arranged by Neil Price Pty Ltd) is suitable and safe for the Event.

Where I use my own motorcycle/equipment, I confirm it is in safe working order, fit for purpose, and properly maintained.

Neil Price Pty Ltd may inspect equipment and may refuse its use or require changes if it is considered unsafe.

7) Accidents, medical treatment, and costs

If an accident occurs, I understand first aid may be provided where practical and that emergency services may be contacted if Neil Price Pty Ltd considers it appropriate.

I understand that I am responsible for all costs associated with medical treatment, ambulance services, evacuation, hospital care, and related expenses, regardless of insurance coverage.

8) Release and assumption of risk (to the extent permitted by law)

To the extent permitted by law, I accept and assume the risks of participating in the Event and agree that Neil Price Pty Ltd is not responsible for loss, injury, or damage arising from those inherent risks.

To the extent permitted by law, I release and hold harmless Neil Price Pty Ltd from claims arising out of my participation in the Event.

9) Damage I cause / my property

To the extent permitted by law, I accept responsibility for:

• loss or damage to my own motorcycle/equipment and personal property; and
• loss, damage, or injury I cause to other people or their property during the Event.

10) International events and third-party providers (applies where relevant)

For international Events or Events involving third-party providers, I understand that Neil Price Pty Ltd may arrange or facilitate goods/services supplied by independent operators (e.g., transport, accommodation, tour operators, motorcycle hire, venues, catering).

I understand Neil Price Pty Ltd is not responsible for the acts or omissions of independent third parties and that separate terms and conditions may apply.

11) Right to refuse participation / removal

Neil Price Pty Ltd may refuse my participation or remove me from the Event (including mid-Event) if I:

• do not follow instructions,
• behave unsafely or recklessly,
• appear impaired by alcohol/drugs, or
• present a risk to myself or others.

12) Photography, video & audio (condition of participation)

I understand and agree that Neil Price Pty Ltd may take photographs, video, and audio recordings during the Event.

As a condition of participation, I grant Neil Price Pty Ltd the right to use my image, likeness, and voice captured during the Event for promotional and commercial purposes in any media, without compensation.

Sensitive situations: If I notify Neil Price Pty Ltd (including at the pre-Event briefing) that I am in a sensitive situation (for example, certain employment/roles or personal safety concerns), Neil Price Pty Ltd will take reasonable steps to avoid identifying me in promotional content. I understand this may not always be possible in wide/scene footage or public environments, but reasonable care will be taken where practical.

Nothing in this clause limits rights that cannot legally be excluded under applicable law.

13) Governing law

This Disclaimer is governed by the laws of Western Australia, and I submit to the jurisdiction of WA courts.

Participant Declaration & Acceptance

By submitting the form below, I confirm that:

• I have read and understood this Disclaimer;
• I agree to be bound by it; and
• I accept the risks of participation to the extent permitted by law, including the Photography/Video/Audio clause as a condition of participation.
